Hannah Jones Swim Academy “HJSA” Terms and conditions.

 

Acceptance of terms and conditions

  • By booking or attending a swimming lesson with us you accept these terms and conditions and they will form part of the contract between us. We reserve the right to vary these terms and conditions at any time without prior notice.

 

Payments and Bookings

  • Group lessons are paid on a full term basis or the remaining classes of the term, payment methods include either Cash or card at reception. (Bank transfer is no longer accepted unless specifically agreed)

  • Bookings are only secured when payment has been received for the full term, the reservation of your space for the following term is implied but will be only be confirmed when we receive full payment, this is typically taken on the last week of the term.

  • We regret that we are unable to offer an alternative for missed lessons. Unfortunately, what seems like one simple request is an impractical administrative task when spread across hundreds of swimmers.

  • Private lessons are required to give 24hrs notice to cancel otherwise full payment is still required.

 

Cancellations

  • We are under no obligation to refund lessons that may be missed due to local adverse weather when the venue and environs are safe and accessible, and lessons are held. We regret that we are unable to offer automatic refunding or rescheduling of lessons in the event of adverse conditions local to you which prevent you from attending a scheduled class.

 

Valuables and jewellery

  • All property left in changing rooms or on poolside and all property (including prams) left in entrance halls or outside, is left at your own risk. HJSA cannot accept any responsibility for the loss or damage of any personal possessions. Please remove all jewellery (except wedding rings) before entering the water.

 

Changing/In the interest of Hygiene

  • No outdoor footwear to be worn poolside or on the steps leading to the pool, any heavily soiled footwear should be removed before entering the changing rooms.

  • Please encourage children to use the toilet before entering the pool and to rinse especially if particularly dirty.

  • Do not take any food or drink into the changing rooms.

  • Please use the mops available in the changing areas to mop up any puddles of water from wet swimwear or using the shower to avoid slippage and keep the changing areas clean and tidy to ensure a comfortable changing environment for all users.

  • We ask that parents take all your used nappies away with you unless there is a clearly marked bin available to dispose of them. Please do not leave nappies in an open bin in our venues for hygiene reasons.

  • Children aged 8 or above should change in their own sex changing room for children under 8 they should enter the changing room dependant on the parent or guardian.

  • Only one parent should enter the changing room with their child to avoid overcrowding in the changing rooms.

 

Illness

  • Should your child or the adult taking your child into the water have, or develop, any known or suspected medical condition, please consult your doctor before swimming.

  • Any new medical conditions should be informed to HJSA at reception or by text message prior to swimming.

  • Never bring your child swimming if they have any illness such as an ear infection, diarrhoea, vomiting, chicken pox, impetigo, conjunctivitis, or a bad cold. Please wait until your doctor has given the all-clear before returning to classes.

  • Please ensure that any sickness/diarrhoea symptoms have completely cleared for at least 48 hours before your lesson; or 14 days if a gastrointestinal bug has been diagnosed by a medical professional.

  • Our teachers may refuse entry to the pool if they reasonably believe that your child is not well enough to participate.

 

Withdrawal of service

  • We may, at our own discretion, refuse a customer entry to swim courses if it is felt that the customers behaviour or the behaviour of those associated with the customer is in anyway unreasonable or becomes an issue of health and safety.

  • Abusive or threatening behaviour will not be tolerated and anyone associated will be asked to leave without notice and any remaining lessons will be forfeited at the cost of the swimmer or guardian.

  • We retain the right to cancel any lessons without notice when health and safety is a concern.

 

Pool/Poolside manner

  • Whilst you are waiting for your class, please keep poolside noise down to a minimum so that all lessons can take place in a calm and peaceful atmosphere. Do not enter the pool until the current class has finished; please always wait to be invited to do so by your teacher.

 

Exclusion of liability

  • Except in the case of death or personal injury arising as a result of negligence, lack of due diligence, breach of duty, or any other circumstance where liability cannot be excluded by law, your participation, or that of your spouse/partner, your child, or those in whose care you have placed your child at HJSA swimming sessions is done so entirely at your and their own risk.

 

Safeguarding

  • Please contact HJSA if you have any safeguarding concerns alternatively there is a dedicated helpline for anyone wishing to raise a safeguarding or welfare concern directly to the Swim England called Swimline on 0808 100 4001.

 

Changes to terms and conditions

  • From time to time we may update these terms and conditions by sending you either an updated version or notification of minor changes. You are free to not accept these changes but we would ask you to notify us in writing of your non-acceptance within 14 days of your receipt, failing which we will be entitled to treat our agreement with you as being subject to the updated version.

Introduction

Please find the following Privacy Policy of Hannah Jones Swim Academy in line with the Data Protection Act 2018 (‘DPA 2018’) and the General Data Protection Regulation (‘GDPR’)

The means by which and type of personal data we collect

Personal data is collected via swimming registration form and via any additional optional information pro- vided in writing, media messaging or verbally by the client. Information collected includes;

  •   If Client >18yrs; Name, address, phone and email contacts.

  •   If client <18yrs; Clients name and DOB plus name, address, phone and email contact details of accompa-

    nying parent/guardian.

  •   Details of swimming ability plus details of medical conditions or disabilities, which may require reason-

    able adjustment to be made during swimming lessons any other pool activities.

  •   Name and contact number for nominated emergency contact.

    The purpose for which I intend to collect and hold personal data

  •   General administrative procedures of business; client register, prompt notice of any lesson cancellations, payment requests, notification of potential extra lessons or other pool sessions, accurate completion of cer- tificates, posting of awards/certificates.

  •   Potential changes to lessons can be discussed.

  •   To ensure appropriate swimming aids and instruction techniques can be applied.

  •   To allow appropriate reasonable adjustments to be made to ensure inclusion.

  •   To uphold the safeguarding of children.

  •   To ensure nominated emergency contact can be informed if any incident arises.

  •   Please be assured that no information supplied is shared with any 3rd parties.

    How and how long we retain personal data

  •   Paper or Electronic registration forms are retained in a folder either in a locked filing cabinet drawer or a locked folder electronically.

  •   Elements of the data from the registration form are used to build client register and emergency contact de- tail list, this is held on a password protected spreadsheet within a password protected personal laptop, plus a back-up hard drive.

  •   Data is retained for up to 12 months after clients find lesson, after which time details are deleted from spreadsheet register and paper registration form is shredded.

    Amendment to or deletion of personal information held

  •   The client should notify Hannah Jones Swim Academy of any changes to personal data that could effect provision of efficient and professional services as outlined above. This can be done in writing at any time.

  •   If a client does not wish any of their personal information to be stored or utilised as described above, they

    can request in writing for it to be deleted, accepting the impact this would have on any ongoing provision of services.

    Client Permission to hold data as detailed

 Completion of, signing and returning of the registration form will be taken as permission to store and use data as described within the privacy notice. If a new registration form is not received for an existing client within 30 days of receiving this notice, the existing registration form will be retained and utilised as described within this privacy notice unless Hannah Jones Swim Academy receives instructions in writing to the contrary.
